1. Acceptance of Terms
By accessing or using the Lafia health concierge platform ("Platform"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Platform.
2. Description of Service
Lafia provides an AI-powered health concierge platform that connects patients with healthcare providers, facilitates appointment scheduling, health tracking, medication management, and personalized health insights. The Platform includes:
- AI health companion with 12 specialist agents (nutrition, medication, chronic care, mental health, sleep, stress, physical activity, triage, and others)
- Wearable device integration for health data tracking
- Social Determinants of Health (SDOH) screening
- Provider escalation and communication tools
- Telehealth consultation scheduling and video visits
- Health score calculations and wellness insights
3. Medical Disclaimer and AI Limitations
IMPORTANT: Lafia is a wellness information and clinical escalation platform. It does NOT provide medical advice, diagnoses, or treatment.
- AI-generated insights, health scores, and recommendations are informational only and should never replace consultation with a qualified healthcare professional.
- The Platform's AI agents may suggest actions, flag concerns, or provide general wellness information, but no AI output constitutes a clinical decision.
- All clinical actions surfaced by the AI (proposed actions, medication suggestions, care plan recommendations) require explicit review and approval by a licensed healthcare provider before they take effect.
- The Platform uses a human-in-the-loop design: AI proposes, the licensed professional disposes.
- Health scores are directional wellness indicators, not clinical assessments. They should not be used as the sole basis for treatment decisions.
If you are experiencing a medical emergency, call 911 (US), 112 (EU/Africa), or your local emergency services immediately. Do not rely on this Platform for emergency medical assistance.
4. User Accounts
- You must provide accurate and complete registration information
- You are responsible for maintaining the confidentiality of your account credentials
- You must be at least 18 years old, or have parental/guardian consent to use the Platform
- You agree to notify us immediately of any unauthorized use of your account
5. Acceptable Use
You agree not to:
- Use the Platform for any unlawful purpose
- Share your account credentials with unauthorized third parties
- Attempt to access other users' accounts or data
- Interfere with or disrupt the Platform's infrastructure
- Upload malicious code or content
- Use the Platform to provide medical advice without proper licensing
- Misrepresent AI-generated content as professional medical advice
6. Provider Terms and Responsibilities
Healthcare providers using the Platform acknowledge and agree that:
- Clinical Decision-Making: All clinical decisions are the sole responsibility of the licensed healthcare provider. The Platform surfaces information and AI-generated suggestions, but the provider retains full clinical authority and liability for patient care decisions.
- Licensing: Providers must maintain valid medical licenses in all jurisdictions where they treat patients through the Platform.
- Escalation Review: Providers are responsible for reviewing AI-flagged escalations in a timely manner. The Platform provides tools and notifications, but clinical follow-through is the provider's responsibility.
- Proposed Actions: The Platform may present AI-proposed clinical actions with confidence scores and trust tiers. Providers must review, approve, modify, or override these proposals. No proposed action is executed without explicit provider authorization.
- Regulatory Compliance: Providers must comply with all applicable healthcare regulations, including HIPAA, state medical practice acts, and informed consent requirements.
- Documentation: Providers are responsible for ensuring the accuracy and completeness of clinical documentation generated through the Platform.
7. Allocation of Responsibility
The allocation of responsibility between Lafia and healthcare providers is as follows:
Lafia is responsible for:
- Platform availability and technical reliability
- Data security, encryption, and access controls
- AI safety guardrails: escalating safety concerns to human providers
- Maintaining audit trails of all AI actions and provider decisions
- Consent management and version tracking
- Accurate data transmission between patients and providers
The healthcare provider is responsible for:
- All clinical decisions made using information from the Platform
- Reviewing and acting on escalations and proposed actions
- Verifying AI-generated information before acting on it
- Maintaining proper licensing and malpractice insurance
- Obtaining informed consent for treatment
- Complying with applicable standard of care requirements
The patient is responsible for:
- Providing accurate health information
- Following up with their healthcare provider for clinical concerns
- Understanding that AI responses are informational, not medical advice
- Calling emergency services for life-threatening situations
8. Payments and Refunds
Fees for services are displayed before confirmation. Payments are processed securely through our payment partners (Stripe for US and global markets, Paystack for African markets). Refund policies are governed by individual provider agreements and applicable consumer protection laws.
9. Intellectual Property
The Platform, its design, code, and content are owned by Lafia Health Technologies. Your health data remains your property. You grant us a limited license to process your data as described in our Privacy Policy.
10. Limitation of Liability
Platform Liability: To the maximum extent permitted by law, Lafia shall not be liable for any indirect, incidental, special, consequential, or punitive damages arising from your use of the Platform. Our total liability shall not exceed the amount you paid to Lafia in the 12 months preceding the claim.
AI Output Liability: Lafia does not guarantee the accuracy, completeness, or clinical appropriateness of any AI-generated content. AI outputs are provided "as is" for informational purposes. Reliance on AI-generated content without professional medical review is at your own risk.
Clinical Liability: Lafia is not liable for clinical outcomes resulting from healthcare provider decisions, even when those decisions are informed by Platform data or AI suggestions. Clinical liability rests with the licensed healthcare provider.
Service Interruption: Lafia is not liable for temporary service interruptions, data delays, or system unavailability. While we maintain high availability standards, the Platform should not be relied upon as the sole channel for urgent medical communication.
11. Indemnification
You agree to indemnify and hold harmless Lafia Health Technologies, its officers, directors, employees, and agents from any claims, damages, losses, or expenses arising from:
- Your use of the Platform in violation of these Terms
- Your provision of inaccurate health information
- Clinical decisions made by healthcare providers using the Platform (for provider users)
- Any breach of applicable healthcare regulations (for provider users)
12. Consent and Data Processing
By using the Platform, you consent to:
- Processing of your health data by AI models for the purpose of generating health insights
- De-identification of your data before transmission to external AI services (patient names are stripped)
- Storage of your health records in FHIR-compliant systems
- Receiving notifications about escalations, appointments, and health updates
You may review and manage your consent preferences at any time through your profile settings. Consent records are versioned and auditable.
13. Termination
We may suspend or terminate your access to the Platform for violation of these Terms. You may delete your account at any time through your profile settings. Upon termination, your health records will be retained in accordance with applicable medical records retention laws.
14. Dispute Resolution
Any disputes arising under these Terms shall first be addressed through good-faith negotiation. If unresolved within 30 days, disputes shall be submitted to binding arbitration in accordance with the rules of the American Arbitration Association, conducted in Dallas, Texas.
15. Governing Law
These Terms are governed by the laws of the State of Texas, United States, without regard to conflict of law provisions.
16. Changes to Terms
We may update these Terms periodically. Material changes will be communicated via email or Platform notification at least 30 days before taking effect. Continued use of the Platform after changes take effect constitutes acceptance of the updated Terms.
